General Terms and Conditions

1. 賞點 LinkPoints is managed and operated by DBApp Factory.
2. Activation of user means will be construed as acceptance of all terms and conditions of 賞點 LinkPoints.
3. 賞點 LinkPoints reserves the right to modify the operation, structure and content of 賞點 LinkPoints, including redemption, conversion and expiry date of points, rewards and offers, redemption and usage of redeem points and / or coupons, these terms and conditions, other items and termination of 賞點 LinkPoints at any time without prior notice. It is users' responsibility to keep themselves up to date in respect of the structure and content of 賞點 LinkPoints, including these terms and conditions. Logging and redemption of points, coupons, rewards and offers means and will be construed as acceptance of all relevant changes. 賞點 LinkPoints will not be liable for loss or damage resulting from the change of structure and content, including these terms and conditions.

About 賞點 LinkPoints

1. Users are required to enter 賞點 LinkPoints and enter required information to register as 賞點 LinkPoints users.
2. Users who do not Google sign in or Apple sign in are required to enter username and password. Email address is optional. The registered email allows the user to request a password reset. 賞點 LinkPoints is not responsible for any undelivered SMS, push notification and email.
3. Users are required to ensure the submitted information on the registration form is authentic, accurate, complete and it does not involve any dishonest or illegal elements.
4. The eligibility of user is at the sole discretion of 賞點 LinkPoints.
5. Points are non-transferable.
6. Users should keep their username and password strictly confidential and in safe custody. Users are fully responsible for any use of their accounts by any person (including any third parties whether with or without authority of the users).
7. In any case of network problem, system malfunctioning, reception of phone calls or blocking by third parties' application programs that cause the delay, loss, mistake or unidentifiable of information transfer, 賞點 LinkPoints will not bear any responsibilities.
8. 賞點 LinkPoints reserves the right to suspend or terminate any users' account without any prior notice if users use accounts that belong to another person, apply for user account, invite friends to register or exercise user privileges in a dishonest or unauthorized way.

Points(LinkPoints ) Earning

1. By presenting user QR code in 賞點 LinkPoints before payment at participating merchants, users may earn points for every transaction subject to the participating merchants' marketing programme and company policy. 賞點 LinkPoints users who have questions regarding its application and / or limits, please contact 賞點 LinkPoints via email cs@linkpoints.hk before purchase.
2. The total points shown on 賞點 LinkPoints system is final. 賞點 LinkPoints do not accept any claim of missing points after transaction.
3. Points shall have no cash value and cannot be exchanged for cash. Points cannot be sold, bought, transferred or moved to other accounts.
4. Points earned on the old 賞點 LinkPoints account will not be transferred to the newly registered 賞點 LinkPoints account.
5. It will not be possible to reset passwords for any guest users and / or users who do not sign in with Google or Apple and / or sign in with no email registration.
6. If a user obtains a refund in relation to any goods or services purchased, the points awarded for that purchase will be deducted from and adjusted in 賞點 LinkPoints account when the refund is made.
7. 賞點 LinkPoints and / or participating merchants shall have the right to cancel or deduct points that are granted to any users by error without prior notice.
8. Users can check their latest points balance on 賞點 LinkPoints. All records of points history in 賞點 LinkPoints database should prevail, final and conclusive. 賞點 LinkPoints does not accept any subsequent claim of any points. In any case of technical issue or system malfunctioning that prevents 賞點 LinkPoints from retrieving information of users' points balance from database, 賞點 LinkPoints will not bear any responsibilities of any loss or damage.
9. In any case of network problem, system malfunctioning, reception of phone calls or blocking by third parties application programs that cause the delay, loss, mistake or unidentifiable information transfer, 賞點 LinkPoints will not bear any responsibilities.
10. If users earn points by any dishonest or illegal means, or in any way that is not stipulated or authorized by or in breach of any of these terms and conditions, including accumulate points using a screenshot of the user QR code or by someone other than the user and / or earning points and / or redeeming coupons or points with transaction made by another person, or staff of participating merchants earning points and / or redeeming points and / or coupons with transactions made by other users, or if 賞點 LinkPoints and / or participating merchants has reasonable grounds to believe that such users earn points by any dishonest or illegal means or in any way that is not stipulated or authorized by or in breach of any of these terms and conditions, 賞點 LinkPoints and / or participating merchants shall have the right to suspend or terminate such users' accounts, cancel any points earned, and claim for any losses suffered by 賞點 LinkPoints and / or participating merchants arising from this.
11. If users breaches any of these terms and conditions, or if we have reasonable grounds to believe that these terms and conditions have been breached by users, the related points will be forfeited. We shall have the right to suspend or terminate that user and lodge a claim for compensation of any losses suffered.
12. In case of disputes related to points, 賞點 LinkPoints and participating merchants reserve the right of final decision.

Redemption and Usage of Coupons and Points

1. Users can redeem desired coupons by using 賞點 LinkPoints. Upon confirmation, the redeemed coupons will be shown at 賞點 LinkPoints instantly. No cancellation is allowed.
2. The coupon includes products and services offered by participating merchants.
3. Users are required to use the redeemed coupons at designated locations or participating merchants within the validity period, otherwise the coupons will be forfeited automatically, no refund of points or rewards is allowed.
4. Users understand and accept that all privileges are with limited quantity, on a first come first served, while stocks last. If users cannot get the privileges or use the coupons before the deadline due to limited stock or other reasons, users understand and accept any unused points and / or coupons for such redemption will not be compensated.
5. All photos or images of products are for reference only, they may vary from actual products. The coupons, products and / or services provided from participating merchants do not include any warranty, exchange, cash refund or change. Users are responsible for checking the quality of products and / or services at the time of coupon usage. No coupons will be re-issued and / or no points will be refunded thereafter in any case. 賞點 LinkPoints has no liability related to any aspect of the food, products or services provided by the participating merchants, including but not limited to the quality and usage.
6. Terms and conditions apply to rewards and privileges provided by participating merchants. Users should refer to participating merchants for a valid period and detailed terms and conditions.
7. Participating merchants reserve the right to change the terms and conditions of the rewards and privileges without prior notice. 賞點 LinkPoints is not responsible for any losses caused by disputes between users and participating merchants.
8. In case of disputes related to coupons redemption and usage, points earning and points redeeming, 賞點 LinkPoints and participating merchants reserve the right to make final decision.
9. In case of disputes related to reward and privilege redemption, 賞點 LinkPoints and the participating merchants reserve the right of final decision.

Use of the Platform (Participating Merchant)

1. 賞點 LinkPoints shall not be liable for coupons that encounter redeem issues due to incomplete, incorrect or missing information provided by participating merchant. Participating merchants are obliged to provide information that is complete, accurate and truthful for the proper processing of the redemption, including the related participating merchants' shop address and contact information.
2. 賞點 LinkPoints reserves the right to cancel any coupons and / or suspend, deactivate or terminate your merchant account in its sole discretion if it reasonably suspects or detects fraudulent behavior or activity associated with your merchant account and / or with your coupons.
3. We may restrict, suspend or terminate your merchant account and / or use of the platform, if we reasonably believe that:
• someone other than you is using your 賞點 LinkPoints merchant account; or
• where you are suspected or discovered to have been involved in any activity or conduct that is in breach of these terms and conditions, our policies and guidelines, or involved in activity or conduct which we deem in our sole discretion to be an abuse of the platform.

Restrictions

1. The following is a non-exhaustive list of the types of conduct that are illegal or prohibited on the platform. 賞點 LinkPoints reserves the right to investigate and take appropriate legal action against anyone who, in 賞點 LinkPoints' sole discretion, engages in any of the prohibited activities. Prohibited activities include, but are not limited to the following:
• Using the platform for any purpose in violation of local, state, or federal laws, rules or regulations, including any false, deceptive, misleading, or fraudulent purpose;
• Posting any content that infringes the intellectual property rights, privacy rights, publicity rights, trade secret rights, or any other rights of any party;
• Posting content that is unlawful, obscene, defamatory, threatening, harassing, abusive, slanderous, hateful, or embarrassing to any other person or entity as determined by 賞點 LinkPoints in its sole discretion or pursuant to local community standards;
• Posting content that constitutes cyber-bullying, as determined by 賞點 LinkPoints in its sole discretion;
• Posting content that depicts any dangerous, life-threatening, or otherwise risky behavior;
• Posting telephone numbers, street addresses, or last names of any person;
• Posting URLs to malicious websites or any form of HTML or programming code;
• Posting anything that may be “spam,” as determined by 賞點 LinkPoints in its sole discretion;
• Harassing, threatening, stalking, or abusing any person;
• Engaging in any other conduct that restricts or inhibits any other person from using or enjoying the platform, or which, in the sole discretion of 賞點 LinkPoints, exposes 賞點 LinkPoints or any of its users, participating merchants, or any other parties to any liability or detriment of any type; or
• Encouraging other people to engage in any prohibited activities as described herein.
2. 賞點 LinkPoints reserves the right but is not obligated to do any or all of the following:
• investigate an allegation that any content posted on the platform does not conform to these terms and conditions and determine in its sole discretion to remove or request the removal of the content;
• remove content which is abusive, illegal, or disruptive, or that otherwise fails to conform with these terms and conditions;
• monitor, edit, or disclose any content on the platform; and
• edit or delete any content posted on the platform, regardless of whether such content violates these standards.
3. You shall not request 賞點 LinkPoints for promotion of any of the following items:
• items classified as hazardous material, dangerous goods, weapons, prohibited or restricted articles by any government or regulatory agencies
• radio-active, incendiary, corrosive or flammable substances, hazardous chemicals, explosives, firearms or parts thereof and ammunition, firecrackers, cyanides, precipitates
• illegally reproduced, infringing or pirated items (e.g., CDs, DVDs)
• passports, credit / debit / ATM cards
• human corpses, organs or body parts, blood, urine and other liquid diagnostic specimens, hazardous or bio-medical waste
• any intoxicant, infectious item or narcotics and psychotropic substances or illegal drugs
• any other items that are illegal, hazardous, dangerous, or otherwise restricted or prohibited under any statute or law or regulation (including without limitation those items that may jeopardize the national security, public security and legal rights of citizens, legal persons and other organizations)
4. Some of the Goods we promote on our platform are subject to restrictions for purchase (“Restricted Goods”), depending on the applicable laws of the country you purchase the Restricted Goods from. These restrictions include minimum age requirements for alcohol / alcoholic / tobacco products and any other goods that participating merchants reserve the right not to sell to you based on the relevant statutory requirements of the time being in force. By placing an order for Restricted Goods, you confirm that you meet the legal requirements to purchase them.

Intellectual Property

1. All trademarks, logos, images, and service marks, including these terms and conditions as displayed on the platform or in our marketing material, whether registered or unregistered, are the intellectual property of 賞點 LinkPoints and / or third parties who have authorised us with the use (collectively the “Trademarks”). You may not use, copy, reproduce, republish, upload, post, transmit, distribute, or modify these Trademarks in any way without our prior express written consent. The use of the Trademarks on any other website not approved by us is strictly prohibited. 賞點 LinkPoints will aggressively enforce its intellectual property rights to the fullest extent of the law, including criminal prosecution. 賞點 LinkPoints neither warrants nor represents that your use of materials displayed on the platform will not infringe rights of third parties not owned by or affiliated with 賞點 LinkPoints. Use of any materials on the platform is at your own risk.

Disclaimer

1. The information is for reference only. 賞點 LinkPoints does not warrant or represent that the information provided here is complete and accurate, or that the information is up to date, and it accepts no liability for any loss or damage howsoever arising from or in reliance upon the content of 賞點 LinkPoints or any third-party sites accessed via 賞點 LinkPoints.
2. To the extent permitted by law, 賞點 LinkPoints (which shall include its employees, personnel directors, agents, representatives, affiliates and parent company) exclude all liability (whether arising in contract, in negligence or otherwise) for loss or damage which you or any third party may incur in connection with our platform, our services, and any website linked to our platform and any content or material posted on it. Your exclusive remedy with respect to your use of the platform is to discontinue your use of the platform. The 賞點 LinkPoints entities, their agents, representatives, and service providers shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of 賞點 LinkPoints or for any other claim related in any way to your use of 賞點 LinkPoints. These exclusions for indirect, special, consequential, and exemplary damages include, without limitation, damages for lost profits, lost data, loss of goodwill, work stoppage, computer failure, or malfunction, or any other commercial damages or losses, even if the 賞點 LinkPoints entities, their agents, representatives, and service providers have been advised of the possibility thereof and regardless of the legal or equitable theory upon which the claim is based. Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, 賞點 LinkPoints, the 賞點 LinkPoints entities, its agents, representatives and service providers' liability shall be limited to the extent permitted by law. Unless otherwise stated, and to the fullest extent allowed by law, any claims against 賞點 LinkPoints by you shall be limited to the aggregate amounts actually paid by and / or due form you in utilizing the service during the event giving rise to such claims.
3. 賞點 LinkPoints shall not be a party to any disputes or negotiations of disputes between users and participating merchants, advertisers and / or sponsors including any third-party. Responsibility for the decisions you make regarding services and / or products offered via the service and / or the platform (with all its implications) rests solely with and on you. You expressly waive and release 賞點 LinkPoints from any and all liability, claims, causes of action, or damages arising from your use of the service and / or the platform, or in any way related to the third parties including participating merchants, advertisers and / or sponsors introduced to you by the service and / or the platform.
4. The platform may contain links to other third party products, websites, services and offers and by clicking on these third party links, you agree to do so at your own risk. These third party links, products, websites and services not owned or controlled by us. 賞點 LinkPoints does not control or endorse these third party websites or links and shall not be responsible for the content, functionality, security, services, privacy policies, or other practices of these third party linked pages. We accept no liability or responsibility for any loss or damage which may be suffered by you in relation to your access and use of these third party links and websites.

The English version of these terms and conditions shall prevail wherever there is any inconsistency or conflict between the Chinese and English version.
